PGNiG: Gazprom abuses its dominant position in eight EU member states

Polskie Górnictwo Naftowe i Gazownictwo SA welcomes the decisions of the Governments of the Republic of Poland and the Republic of Lithuania announced on 27th and 28th of February 2019. The governments of both countries decided to join PGNiG SA in the court proceedings initiated by the Company with an action against the decision of the European Commission on a commitment agreement between the European Commission and Gazprom concluding the proceedings on the alleged abuse of dominance of Gazprom on the markets of eight European Union countries (case AT.39816).

We would also like to inform that on 27th of February 2019 the Court of Justice of the European Union informed PGNiG SA that the above mentioned action was also joined by the Bulgarian gas distribution and retail company Overgas Inc., whose significant shares are owned by companies from Gazprom capital group – we read in company’s communique.

By subjecting the European Commission’s commitment agreement with Gazprom to the judicial review of the Court of Justice of the European Union, the Governments of the Republic of Poland and the Republic of Lithuania, as well as PGNiG SA and Overgas Inc., will be able to prove that this decision is not only contrary to EU law, but also strengthens Gazprom’s dominant position on the regional gas market in Central and Eastern Europe and has a negative impact on the functioning and competition in the EU internal gas market.
