OPAL made a complaint after loss in the legal dispute
The Energate portal reported that OPAL Gastransport GmbH has appealed against the decision of the German regulator Bundesnetzagentur (BnetzA) before the Higher Regional Court in Dusseldorf. It is a decision implementing the judgment of the Court of Justice of the European Union (CJEU) restricting Gazprom’s access to OPAL, the branch of Nord Stream in Germany.
Until the complaint is reviewed, the decision will continue to be implemented. BnetzA ruled that Gazprom must reduce gas transmission through OPAL as a result of the judgment of the CJEU admitting Poland is right in a dispute with the European Commission about its decision allowing the Russian company to use the full capacity of OPAL, and thus send more gas through Nord Stream. In the opinion of the CJEU, the decision was taken against the principle of energy solidarity and without the necessary analysis of the impact on the Polish market.
OPAL Gastransport GmbH is the operator of the OPAL gas pipeline that discharges gas from Nord Stream through Germany along the Oder line to the south.
