Majewski: Opinion of the spokesman of the CJEU on OPAL is also binding in the case of Nord Stream 2

The CEO of PGNiG believes that a possible positive ruling by the CJEU regarding the use of the transmission capacity of the OPAL gas pipeline may be used in the battle for the future of Nord Stream 2.

– The ruling of the Advocate General of the Court of Justice of the European Union is of fundamental importance as it emphasizes that the principle of European energy solidarity is a legally binding principle for the EU institutions and the Member States. It must be remembered that this principle was entered into the Lisbon Treaty as a result of Poland’s strong efforts. This ruling, which precedes the final ruling by the CJEU, confirms the validity of this argument. This court ruling is important not only for the OPAL gas pipeline. It must be remembered that the construction of Nord Stream 2 is underway, the implementation of which interferes with the situation of the energy market in Poland, but also in Europe – said Paweł Majewski, president of PGNiG.

– We hope that if the Tribunal continues this line of argument, the principle of energy solidarity will also be maintained in the context of the Nord Stream 2 gas pipeline – he said.
