Nord Stream 2 sues the gas directive

The operator of the Nord Stream 2 gas pipeline project filed a claim to the Court of Justice of the European Union demanding to cancel the amendment of the gas directive. According to Nord Stream 2 AG, the amendment approved in mid-April was prepared and adopted in order to create unfavorable conditions that would impede the construction of the Nord Stream 2 gas pipeline.

– As a prudent investor, we intend to defend our investments. The amendment of the gas directive is harmful not only to the Nord Stream 2 project. This obvious discrimination of the commercial project also weakens the ability of the European Union’s internal market to attract investment that would allow the transition to low-carbon energy sources – said Matthias Warnig, president of Nord Stream 2 AG.

The company also announced that it also reserves the right to claim its rights in accordance with international legislation. It does not exclude the opening of separate arbitration proceedings against the European Union.

According to the amendment of the gas directive approved in April, all submarine parts of gas pipelines in the EU will be subject to EU law. In the case of the Nord Stream 2 section, the route of which will also run outside German territorial waters, the conditions of use will have to be determined through negotiations between Germany and Russia. Their effect is to be approved by the European Commission, which raises opposition of Russian Federation.
