The Ministry of Climate will adjust the act on the capacity market to the new emission standards
The draft amendment to the act on the capacity market was included in the list of legislative and program works of the Council of Ministers. The changes mainly concern the adjustment of the act to the EU regulations related to the emission reduction of generation sources.
The Ministry of Climate emphasizes that the preparation of the draft amendment is the necessity to ensure compliance of the provisions of the Capacity Market Act with EU regulations (Regulation 2019/943) regarding the requirements for generation capacity mechanisms, including carbon dioxide emission limits. In the justification to work on the draft, we read that the provisions of Regulation 2019/943 from July 4, 2019 exclude new generation units from participation in the capacity market, i.e. those that do not conduct commercial production before that date, emitting more than 550 g CO2 / kWh. It is also about such existing units that from July 1, 2025, carry out commercial production, before July 4, 2019, emitting more than 550 g CO2 / kWh and over 350 kg CO2 / kW per year. – These emission limits, however, do not apply to capacity contracts concluded before December 31, 2019 – emphasizes the ministry.
