OSW: A gas pipeline ‘above the law’? The EU Council’s legal service gives its opinion on Nord Stream 2

On 27 September, the legal service of the Council of the European Union issued a legal opinion on the European Commission’s proposal to the EU Council for permission to start negotiations with the Russian Federation on the issue of adopting a special legal framework for the Nord Stream 2 gas pipeline. The content of the 25-page opinion was revealed in the media (Politico Europe) a few days later. The document is part of the internal legal procedure within the EU Council’s framework, and it discussed whether the proposal put forward by the EC is in accordance with EU law. It refers to the question of whether it is legitimate to apply EU law to the Nord Stream 2 project, the potential conflict between EU law and other legal regimes, the division of competences between the EU bodies and the member states in the field of international agreements, and also offers an interpretation of the principles of the EU’s energy security – write Szymon Kardaś and Rafał Bajczuk, experts from OSW.

Norway’s gas deposits to last for years 

Within a decade PGNiG has invested about PLN 5.3 bn in the Norwegian Continental Shelf. Since starting production in 2012, the company has extracted 2.14 bcm of natural gas and almost 2.2 m tons of oil. The question is how much the deposit can still yield? Fine for Lithuanian Railways does not cover PKN Orlen’s losses 

The European Commission fined the Lithuanian Railways EUR 28 m for removing a rail track to PKN Orlen’s refinery in Mažeikiai and thus breaching the EU antitrust rules. According to Marek Zuber, an economist, Brussels made the right decision. 

New US sanctions against Russia in November. They will hit Nord Stream 2

USA is going to introduce new sanctions against Russia. They may limit financing of Russian banks and oil and gas companies, including Nord Stream 2. New limits will be valid from 28th of November. Accurate directives have been published on the American Treasury Department website.
